This legislation marks a new chapter for crypto payments in Brazil, even if we’re not yet ready to see Bitcoin used as a legitimate currency like a dollar or a real (the Brazilian currency, not the one where you pay for the next blockbuster film).
The Lowdown on the Legislation
So, what exactly does the newly minted law do? For starters, it does not elevate cryptocurrencies like Bitcoin to legal tender status. That title, dear Bitcoin maximalists, is reserved for the Brazilian real. However, the law broadens the definition of legal payment methods to include various digital currencies. This means you can pay for your caipirinha at the beach with crypto, well, as long as the vendor agrees.
Licensing and Regulation: Who’s in Charge?
While the law brings structure to the crypto payment landscape, it doesn’t specify which government body will oversee these operations. Similar to the United States’ approach, assets classified as securities will find a home under the regulatory gaze of Brazil’s Securities and Exchange Commission. Following the wake of the FTX collapse, the law incorporates critical provisions requiring crypto exchanges to play nice by distinguishing between user and company assets. When Can It Happen?
The law is set to come into effect in 180 days, which means by June 2023, Brazilian residents might just be sipping their coffee, instantly converting it to crypto to pay for their pastries. Meanwhile, Bolsonaro will hand over the reins to Luiz Inácio Lula da Silva on January 1, a leader who’s previously shown more enthusiasm for blockchain adventures. Who knows?
