OpenAI Faces Garante’s Demands: Compliance Deadline Looms for ChatGPT

Italy’s data protection agency, known as Garante, has thrown down the gauntlet to OpenAI regarding its AI chatbot ChatGPT. The agency issued an order in March 2023 under the suspicion that OpenAI was running afoul of the EU’s General Data Protection Regulation (GDPR). What’s Required from OpenAI?

In a recent press release, Garante outlined several homework tasks for OpenAI to get back in its good books, including:

  • Age-Gating Measures: They need to implement rigorous methods to keep minors out of their chatbot, like a bouncer at a nightclub—no one under 21 allowed!

Users’ Rights on the Table

The Garante wants to ensure that users—and even non-users—can exercise their rights regarding personal data. This means individuals should be able to:

  • Request corrections for any misinformation generated by ChatGPT.
  • Delete their data entirely.

Think of it as a data spring-cleaning where you’re allowed to toss out anything you don’t want cluttering your digital space.

Awareness Campaigns Galore

To really ensure the message gets across, Garante has also mandated that OpenAI conducts a campaign in Italy to inform everyone about data processing operations. This might involve a few posters, some witty slogans, or maybe even a catchy jingle. “OpenAI’s cooking with data, let’s make sure it’s safe on the plate!”

Deadlines Are Tight!

Garante has set a deadline of April 30 for OpenAI to complete most of the tasks. If that didn’t sound daunting enough, they have given extra time for moving to a stronger age verification system, making the “fines aren’t on the menu” option not quite so appetizing.
