In an April 19 filing to the Southern District of New York, Bankman-Fried’s lawyers, Mark Cohen and Christian Everdell, declared they had met all bail conditions set forth in the court order, except for this one pesky detail—monitoring the usage of his parents’ brand new cell phones.
According to the filing, their high-tech enthusiasm ran into a snag: “We learned recently that the monitoring software installed on the new cellphones we purchased for Mr. Bankman-Fried’s parents cannot, in fact, automatically photograph the device’s user every five minutes as required by the Order.” Talk about a tech fail!
Optimism Amidst Technical Challenges
Despite the hiccup, Cohen and Everdell are maintaining a sense of optimism. They expressed hope that they have unearthed a solution but need more time to conduct tests and ensure the software works as intended. They requested just a couple of extra days, until April 21, to tighten up their monitoring tech.

While they work on a solution, the legal team is holding a lifeline to keep Bankman-Fried’s parents connected. They’ve asked permission for the couple to continue using their existing phones—those trusty, old-school devices that seem to have dodged the tech turmoil.
The Technical Bugaboo: Is the Phone Model the Real Culprit?
Ken Gamble, head honcho at private intelligence firm IFW Global, weighed in on the unfolding drama. “There could be a conflict between the choice of phone model and the monitoring software. Some newer models have security measures that make installing monitoring software a no-go without some serious bypassing—like jailbreaking!”
Gamble suggests that finding an alternative phone model that can accommodate the monitoring software might just be the ticket, stating, “This will take time. They have to get to the root of the technical issue, find the solution, and potentially even make another application to the court for more time.” Sounds like a lot of moving parts to keep track of!
Judicial Scrutiny: Electronic Access Concerns
Amid this tech stumble, concerns about Bankman-Fried’s access to digital devices have reached a boiling point. Judge Kaplan recently noted that Bankman-Fried had a virtual “garden of electronic devices” at his disposal, raising eyebrows and suspicion regarding potential witness tampering. On March 4, the judge even suggested that Bankman-Fried should be limited to using a flip phone—talk about a tech downgrade!
Additionally, Bankman-Fried’s parents have agreed to restrict his access to any electronic devices, signing affidavits to ensure no prohibited tech enters their home. It’s a clear indication that the stakes are high, and every pixel of digital communication is under vigilant scrutiny.
